Seminar discusses legal certainty in Tax Law

On November 5 and 6, the Nucleus for Fiscal Studies (NEF) of FGV’s Sao Paulo Law School (Direito SP) will hold the seminar “Interpretation and Legal Certainty in Tax Law”. Distinguished legal experts, lawyers, prosecutors and judges will attend the event and face current and controversial issues on the topic, such as the modulation of the effects of decisions and the consequences of changes in case law, the obligation and exceptions to the enforcement of qualified precedents and of ratio decidendi in administrative trials, and the effects of decisions for compliance, provision and contingency purposes.

The event will be attended by the creators of the new Introduction to Brazilian Law Act (Lindb), which will be explored, especially as to the effects that must be assigned to the tax motivation and comprehensive assessment of all arguments (articles 20 and 21 of the Lindb and new Code of Civil Procedure), as well as the enforcement of articles 23 and 24 of the Lindb to tax assessments and respective decisions due to a change in the general orientation.
