FGV and Rio de Janeiro State Court of Appeals launch mediation project focused on corporate reorganization

Between February 22 and March 4, 2021, FGV Knowledge and the Rio de Janeiro State Court of Appeals’ Consensual Conflict Resolution Center (NUPEMEC) will hold their first mediation project for disputes related to the restructuring of companies whose processes were affected by social distancing arising from the COVID-19 pandemic.
The project will mediate approximately 85 cases arising from the corporate reorganization of construction company Odebrecht, completely online, through the e-NUPEMEC platform.
Mediation is a non-adversarial method of conflict resolution based on consensus and the autonomy of the parties’ will. Disputes are handled with the help of a mediator, an impartial third party without decision-making power, who facilitates communication so that those involved can find a solution that is broadly satisfactory.
This pioneering approach by NUPEMEC, combined with FGV Knowledge’s expertise, looks set to accelerate processes while providing all parties with legal security and safety.
