New legal book explores law and economics applications

Fundação Getulio Vargas’ Rio de Janeiro Law School has just launched a book titled “Aplicações em Direito e Economia” (“Applications in Law and Economics”). Organized by professors Armando Castelar, Antônio Maristrello Porto and Patrícia Sampaio, the publication is one of the results of the school’s Law, Economics and Justice Knowledge Promotion Project. This project is aimed at encouraging reflection on the relationship between law and economics applied to legal activity.

The project, which involves both education and research activities, is conducted by the FGV Rio de Janeiro Law School in partnership with several courts and their judicial colleges. “Aplicações em Direito e Economia” is the project’s most recent output. The book presents articles written by judges at the Regional Federal Court of the Third Region, who have been taking part in the project through the court’s judicial college.

Reading the collection of articles, it is possible to understand the complexity and interdisciplinarity of the topics covered, which richly illustrate how the issues taken to court by society, which judges are called upon to resolve, are varied (and often difficult).

The publication addresses the following subjects: “Economics analysis of law and public policies for income redistribution” (Carla Abrantkoski Rister and Ronald de Carvalho Filho); “Incomplete contracts and theory of transaction costs in a practical assessment” (Douglas Camarinha Gonzales and L’Inti Ali Miranda Faiad); and “Economic analysis of law in assessing the legal and economic impacts of the late judgment of Special Appeal 574,706 by the Federal Supreme Court” (José Marcos Lunardelli and Marcelo Guerra Martins).

The book also covers the following topics: “Analysis of the consequences of repossession in the scope of government housing programs” (Sheila Pinto Giordano); “Brief notes on the sharing economy and its legal and regulatory challenges” (Sylvia Marlene de Castro Figueiredo); and “The fiscal cost passing-on defense thesis and a legal-economic analysis of article 166 of the National Tax Code: revisiting the problem of legitimacy for the repetition of undue payment of indirect taxes” (Tiago Bitencourt De David).

“The richness of the themes presented in this book is undeniable. In it, readers will find in-depth approaches to extremely significant legal issues, which illustrate how tools in the field of economics can contribute to more accurate diagnoses and more appropriate solutions to highly complex social problems,” says Professor Patrícia Sampaio, one of the book’s organizers.
