Research on human rights and gender wins international award

Taís Penteado, a student doing a doctorate in law and development at Fundação Getulio Vargas’s Sao Paulo Law School, was the winner of the 2023 Audre Rapoport Prize for Scholarship on Gender and Human Rights at the University of Texas School of Law. Dedicated to rewarding interdisciplinary work on human rights and gender, this prize is bestowed annually to master’s and doctoral students who produce outstanding papers in this field.

Penteado has an undergraduate degree and a master’s in law from the Sao Paulo Law School and an LLM from Yale Law School, where she was also a visiting researcher. In her work, she addresses the complexity of subordination in legal contexts. The study in question, funded with a scholarship from the Sao Paulo State Research Foundation (FAPESP), looks at how the Brazilian Federal Supreme Court’s criminalization of LGBTQ-phobia illuminates complications that arise when more substantive versions of the principle of equality are applied to the analysis of law.

In her paper, she argues that legal decisions based on the anti-subordination principle must consider the various ways in which inequalities manifest themselves, the dynamic nature of power relations and the intersectional character of inequalities. The means by which subordination manifests itself pose challenges for the resolution of cases based on the principle of equality. Thus, part of the study sets out a preliminary proposal for a new theory of interpretation (referred to by the author as a “Joint Venture Theory of Interpretation”), which reflects on the possible institutionalization of popular participation in the resolution of conflicts of this nature.
