Jurisdictional Prerogative addressed in 5th edition of Supreme Court in Numbers report

In this 84-page edition, FGV professors present data from the Brazilian Supreme Court and clarify the characteristics of waste in the processing of jurisdictional prerogative at the Court.

FGV’s Rio de Janeiro Law School (FGV Direito Rio) has recently released the 5th edition of ‘Supremo em Números’ [Supreme Court in Numbers], under the theme ‘Jurisdictional Prerogative and the Supreme Court.’ The project produces detailed annual thematic reports, showing different facets of the Brazilian Supreme Court (STF) from a statistical standpoint.

In this 84-page edition, Professors Joaquim Falcão, Ivar A. Hartmann, Guilherme da Franca Couto Fernandes de Almeida, and Luciano Chaves, in addition to presenting data from the STF, clarify the characteristics of waste in the processing of jurisdictional prerogative at the Court.

“Proposals to change jurisdictional prerogative rules could impact 95% of criminal actions pending in the Supreme Court. The jurisdictional prerogative system is incapacitating. Only 5.94% of these proceedings began (as investigations) and ended in the Supreme Court,” said project coordinator Ivar A. Hartmann.

The average prosecution time of criminal actions in the Supreme Court has grown consistently since 2002. In extreme situations, cases await measures from the judge-rapporteur for four years, from the judge-reviewer for one year, and remain with the Federal Attorney General’s Office (PGR) for two years.

Structured from criminal actions, the book also features the most frequent matters and their results, with several mentions in sentences, bills, confirmation hearings of potential justices, and the media in general.
