FGV launches new book on the Theory of the Regulatory State

A critical outlook on key topics regarding the State’s role in regulatory, economic and social intervention and its upshots, based on regulatory experiences in Brazil and abroad. That is the underlying theme of the second volume of the book “Teoria do Estado Regulador” [Theory of the Regulatory State], compiled by professor Sérgio Guerra, from FGV’s Rio de Janeiro Law School (Direito Rio).

In a series of articles, the book features analyses by several experts on the role of the Brazilian government under the bias of regulation. The authors studied the role of the Federal Court of Auditors in overseeing public port service concessions, the characteristics of the Brazilian regulatory State, and the possibility of limiting access to broadband internet by Anatel, the national financial system, and many other subjects.

“This second volume is the result of quality work performed with excellence by 13 students of Direito Rio’s Master’s in Regulatory Law program, providing a valuable contribution to the much needed debate of concepts and ideas regarding the new paradigms of administrative law and the Brazilian regulatory State,” said Sérgio Guerra.

Initiated with the 1988 Constitution and the first initiatives to privatize state-owned companies, public service concessions, and the creation of regulatory agencies in the early 1990’s, the regulatory State plays a key role in the economic and social fields, covering the municipal, state and federal realms.
