Experts debate alternative solutions to settle conflicts in Japan

Daniela Gabbay, professor of ‘Organization of Justice and Procedure’ and ‘Mediation and Arbitration’ at FGV’s Sao Paulo Law School (Direito SP), was one of the lecturers at the ‘Brazil-Japan Litigation and Society Seminar’ held on January 8 and 9 at Shinshu University in Matsumoto, Japan.

As an expert in mediation and arbitration, Daniela presented a paper co-written with Ricardo Ferreira Pastore on the use of mediation in indemnity actions for cartel formation. Both participated in the panel on Courts and ADR (Alternative Dispute Resolution) along with professors Fernanda Tartuce, from FADISP, and Tsuneo Niki, from Osaka University. 

“The recent changes in the New Code of Civil Procedure and mediation laws emphasized the usefulness of this resource to efficiently settle disputes involving continued relations. In this sense, the field of competition can be fruitful for mediation practices to offset damages caused by cartel formation, as is already the case in other countries”, said the professor.
