Course in Portugal addresses tax arbitration

The Lato Sensu Graduate Program (GVlaw) of FGV’s Sao Paulo Law School (Direito SP) and institute LexDebata (Portugal) will offer a short-term course on tax arbitration between February 26 and March 2. Classes will be held in Lisbon by professors Tathiane Piscitelli and Tânia Carvalhais Pereira.
Tax arbitration is regulated in Portugal since 2011 and widely recognized by all legal operators and even the Court of Justice of the European Union. Its application in Brazil, however, is still incipient. Law No. 9.307/96, which regulates the institute of arbitration, was amended in 2015 to allow direct and indirect public administration to use arbitration to settle disputes related to property rights.
“Brazil and Portugal face very similar challenges, regarding the effective deployment of the system,” said Tathiane Piscitelli. Among the subjects addressed is the alleged unavailability of tax credit, the limits of income waiver, and inflexible methods to appoint arbitrators.
