Practice of Pro Bono Legal Services in Brazil is discussed at São Paulo Law School

Over the past week, FGV's São Paulo Law School, in partnership with Pro Bono Institute, New Perimeter and PILNet (Public Interest Law Network), hosted a short course to discuss the regulation of Pro Bono Legal Services, which resulted in a closing debate on Friday, the 28th.The meeting was attended by Marcos Fuchs, director of the Pro Bono Institute; Ed Rekosh, president and founder of PILNet; Elisabeth Dewey, a Pro Bono member of the office DLA Piper and director of the NGO New Perimeter; Eloísa Machado, co-coordinator of Supremo em Pauta of São Paulo Law School and member of Coletivo de Advogados; Flavio Pereira Lima, partner at Mattos Filho, Veiga Filho and adviser of the Brazilian Bar Association, and Gustavo Reis, public defender of São Paulo.In Marcos Fuchs' opinion, the evolution of Pro Bono Legal Services in São Paulo began with the first resolution of 2002. The Pro Bono Institute found that this measure was the first step, but it was still restricted to NGOs and listed nonprofit entities of the third sector. The exclusion of natural persons of pro bono service did not contribute to the expansion of citizenship. However, with the recent deregulation of that resolution, it is expected that later this year we will have a more comprehensive resolution, including all the national territory.Flávio Lima emphasized the importance of realizing how the debate on pro bono legal services is understood within the regulating body of the legal profession in the country. Firstly, recalled the lawyer, most attorneys work alone, which is a very different reality from large offices. It is estimated that among the 250,000 lawyers registered in the bar association, around 40,000 rely on agreements with OAB to act as dative lawyers.In Gustavo Reis' opinion, Pro Bono legal services do not compete with the role that advocacy plays in the defense of rights and access to Justice. They are like players with different shirts, playing for the same team, he explained. The public defender's office cannot deal with all the demands, and therefore, pro bono legal services are essential for the consolidation of democracy through the expansion of the right of access to Justice.
