, 11/08/2017Extensions and New Bids: Provisional Decree 752, of 2016, and the Government Policy for InfrastructureThe Provisional Decree, 752, of 2016, was the subject of significant discussions in congress. It basically set forth extensions of concessions in the rail industry and the possibility of new bids (a sort of friendly expiry) in the highway and airport industries. The main goal would be to resume investment in infrastructure without characterizing an opportunistic renegotiation on the part of the concessionaire or the government. In the specific case of the rail industry, the conversion bill added a specific provision about right of access. Having assisted the rapporteur in the Chamber of Deputies about this Provisional Decree, the idea is to present the main elements that permeated the legislative discussions that resulted in Law 13448/2017.
