New energy disputes: Experts discuss trends and challenges in sector

The FGV Mediation and Arbitration Chamber recently held a seminar called “New Energy Disputes” in the FGV 9 de Julho Room in Sao Paulo, bringing together renowned energy sector officials, academics and specialists to debate the new frontiers of energy disputes in Brazil.

André Junqueira, Sao Paulo state attorney, emphasized the significance of the meeting, stating that it was “the standout event in Sao Paulo Arbitration Week” due to the importance of the topics discussed for the sector’s future. The event featured two panel discussions, which delved into innovative and timely issues in the energy sector, highlighting trends and challenges faced by the industry in Brazil.

The panels, focused on out-of-court solutions to disputes in the sector, stressed both the origins of disputes and methods to settle them, underlining the relevance of extrajudicial conflict resolution mechanisms in the context of the energy transition.

About the FGV Mediation and Arbitration Chamber

The chamber acts as a kind of court registry and is responsible for managing the proceedings. When a dispute arises and the parties agree that it will be resolved by an extrajudicial method, such as arbitration, mediation or a dispute board, either at the time the contract is signed or afterward, one party contacts the FGV Chamber’s Secretariat and submits the basic documents required to settle the dispute, listed in the chamber’s regulations for the chosen procedure.

Once a request for initiation has been received and the fee has been paid, the chamber is responsible for notifying the other party and then monitoring the entire flow of the procedure from start to finish.

This year, the FGV Chamber celebrated its 22nd anniversary. Since it was founded, it has become a leader in its area in Brazil, thanks to its procedural management model and its commitment to upholding the quality standards for which FGV is known.
