Bill written by FGV student to improve anti-fraud measures in public tenders is presented to Rio de Janeiro State Legislative Assembly

A bill aimed at improving anti-fraud measures in public tenders involving the state government of Rio de Janeiro, written and proposed by Henrique Torres Pitanga Miguel, an undergraduate student at FGV’s Rio de Janeiro Law School, was presented to the Rio de Janeiro State Legislative Assembly by state representative Renan Ferreirinha on November 25, 2020.

Bill 3,373 of 2020 seeks to offer solutions to tackle the long-standing occurrence of fraud in large public tenders involving the state government, by enhancing the integrity programs of bidding companies.

The bill would alter Law 7,753 of October 17, 2017, which “provides for the creation of an integrity program at companies that supply goods and services to the state government of Rio de Janeiro and other measures.” In the “justification” section of the bill, Ferreirinha stresses the instrument’s importance.

“This proposal is of huge significance. It is designed to improve the effectiveness of corporate integrity programs in the state of Rio de Janeiro, and consequently hinder the frequent cases of corruption that plague us,” the state representative says.

Henrique developed the bill as his term paper for the Field Project led by Professor Michael Freitas Mohallem, called “Anti-Corruption Measures: Legislative Techniques and Advocacy for the Development of New Laws,” which examined techniques for fighting corruption.

“With the help of Professor Mohallem, during the semester I managed to develop some legislative construction techniques, in particular in the field of anti-corruption measures. The Field Project gave me the opportunity to suggest this bill,” Henrique explains.
