Arbitration at the ANP: an important tool for administrative efficiency in the oil and gas sector
ANP Attorney General highlights the advances, challenges and relevance of arbitration for administrative efficiency at FGV Chamber event.
In November, the Getulio Vargas Foundation's Mediation and Arbitration Chamber (FGV Chamber) held the event "Extrajudicial Overview of Dispute Resolution in the Oil and Gas Sector", in Rio de Janeiro. The meeting was curated by Maria D' Assunção and Giovani Loss, professional experts on the subject.
With a program structured in two panels, the event addressed key issues for the industry:
- Panel 1 - Legal certainty in oil and gas contracts
- Panel 2 - Arbitration and the ANP: Emblematic Cases and Future Prospects
Among the speakers, Federal Prosecutor and ANP Attorney General, Evandro Pereira Caldas, highlighted the role of arbitration in the National Petroleum, Natural Gas and Biofuels Agency (ANP). He mentioned that the ANP has been involved in 15 arbitrations, of which 11 have been concluded and 4 remain ongoing.
The ANP Attorney General also shared insights into emblematic cases and the importance of the continued development of extrajudicial mechanisms. He stressed that arbitration is an essential tool for ensuring administrative efficiency and that arbitrators must act to prevent abuse or violation by the state of private investors, while respecting the regulator's competence.
The debates reinforced the importance of extrajudicial methods, such as arbitration, in promoting legal certainty and efficiency in contracts in this strategic industry.
The FGV Chamber
The unit acts as a kind of court registry and is responsible for managing the proceedings. When a dispute arises and the parties agree that it will be resolved through some extrajudicial method - such as arbitration, mediation and dispute boards - either from the moment the contract is signed or afterwards, the party goes to the FGV Chamber's office and submits the basic documents for the dispute, listed in the Chamber's Regulations for the chosen procedure.
Once this request for initiation has been received and the fee and opening of the procedure have been paid, the Chamber is responsible for notifying the counterparty and then monitoring the entire flow of the procedure from initiation to closure.
In 2025, the Chamber celebrates 23 years since it was founded. During this time, it has become a benchmark on the national scene for its procedural management model and its commitment to the quality that comes with the FGV seal.
